SKLEYS — TERMS OF SERVICE
Effective Date: 1 September 2026
These Terms of Service govern access to skleys.com and purchases made through the SKLEYS online store.
1. WHO WE ARE
The website skleys.com and the SKLEYS online store are operated under the SKLEYS brand.
Legal and business-identification information is available in our Legal Notice.
Nothing in these Terms limits any mandatory rights that cannot legally be excluded.
2. ACCEPTANCE AND LEGAL CAPACITY
2.1 By placing an order through our website, you confirm that you have the legal capacity required to enter into the purchase contract.
2.2 Where you are acting as a consumer, the mandatory consumer-protection rules applicable to your purchase prevail over any provision of these Terms that conflicts with those rights.
2.3 If you purchase products for purposes relating to your trade, business, craft or profession, certain consumer-specific rights described in these Terms may not apply to you.
3. PRODUCTS AND PRODUCT INFORMATION
3.1 We take reasonable steps to ensure that product descriptions, characteristics, sizes, colours, prices and photographs are accurate.
3.2 Product images are intended to represent the products offered for sale.
Some visual content, campaign imagery or model photography may be created, modified or enhanced using digital or artificial-intelligence tools.
The use of such tools does not alter our obligation to provide goods that conform to the contract and to the material product characteristics communicated to you before purchase.
3.3 Minor differences in colour may occur because of lighting, photography or differences between screens and devices.
This does not mean that SKLEYS may supply a product materially different from the product purchased.
Material characteristics such as design, construction, composition, included components, size and other characteristics relevant to the purchase must correspond to the contract, subject to any differences clearly disclosed before purchase.
3.4 Size information is provided on the relevant product page where applicable. Customers should consult the available sizing information before ordering.
4. ORDERS AND FORMATION OF THE CONTRACT
4.1 Products displayed on the website constitute an invitation to place an order and not, by themselves, a binding offer.
4.2 After placing an order, you will receive an electronic acknowledgement or confirmation.
The sales contract is concluded when your order is accepted in accordance with our checkout and order-confirmation process.
4.3 We may refuse or cancel an order where there is a legitimate reason, including:
- an obvious pricing or technical error;
- inability to supply the product;
- suspected fraud or unauthorised payment;
- incorrect or incomplete information preventing fulfilment;
- another lawful reason that prevents us from completing the transaction.
4.4 If we cancel an order after payment has been collected and no substitute arrangement has been agreed, the corresponding amount will be refunded using the applicable payment method.
5. PRICES, TAXES AND PROMOTIONS
5.1 The price applicable to an order is the price displayed before the order is submitted, subject to correction of obvious errors in accordance with applicable law.
5.2 Prices displayed to consumers include applicable taxes where required by law.
Any mandatory shipping or other charges payable by the customer will be disclosed before the customer places the order.
5.3 Where SKLEYS announces a reduction in price, any previous or reference price used for that reduction will be determined in accordance with the applicable rules governing price-reduction announcements.
Where EU/Spanish rules requiring use of the lowest price applied during the preceding 30 days apply, the reference price will be determined accordingly.
5.4 Promotional codes, discounts and special offers may be subject to specific conditions communicated with the relevant promotion.
Promotional conditions do not remove mandatory consumer rights.
5.5 SKLEYS will not use these Terms to validate an artificial, fictitious or misleading reference price.
6. PAYMENT
6.1 The payment methods currently available are displayed during checkout.
Depending on the country and checkout configuration, payment may be processed through providers such as Shopify Payments, Stripe, PayPal or other payment providers displayed at checkout.
6.2 By submitting an order using a selected payment method, you authorise the relevant payment provider to process the amount shown at checkout.
6.3 Payment may be subject to fraud-prevention and security checks.
6.4 Where a payment is rejected, reversed or identified as unauthorised, we may suspend or cancel the affected order where legally permitted.
6.5 Nothing in this section limits any statutory refund, consumer-protection or payment-dispute rights.
7. SHIPPING AND DELIVERY
7.1 Orders may be fulfilled and dispatched through international fulfilment partners and warehouses, including facilities located outside the European Union.
7.2 The processing and estimated delivery times applicable to an order are described in our Shipping Policy and/or during the purchase process.
7.3 Delivery estimates are estimates rather than guarantees unless a delivery date has expressly been agreed as binding.
We nevertheless remain subject to mandatory consumer rules regarding delivery.
7.4 Delays may occur because of circumstances such as:
- exceptional demand;
- carrier disruption;
- customs procedures;
- incorrect or incomplete delivery information;
- exceptional weather;
- public holidays;
- force majeure;
- other circumstances reasonably outside our control.
Nothing in this clause removes remedies that mandatory consumer law grants where delivery is delayed.
7.5 An order containing several products may be divided into more than one shipment.
In that case, you may receive separate tracking numbers and the parcels may arrive on different dates.
7.6 Once an order has been dispatched, tracking information may take some time to become active in the carrier's system.
8. RISK DURING DELIVERY
For consumer purchases, the risk of accidental loss or damage generally remains with SKLEYS until you, or a third party designated by you other than the carrier, acquire physical possession of the goods.
Where you independently appoint a carrier that was not offered by us, the rules established by applicable consumer law apply.
For business customers, different rules may apply where legally permitted.
9. INTERNATIONAL ORDERS, TAXES AND CUSTOMS
9.1 SKLEYS sells and fulfils orders internationally.
Products may be dispatched from outside the country in which the customer is located.
9.2 Taxes, import VAT, customs formalities and other cross-border obligations depend on factors including:
- the destination country;
- value of the consignment;
- origin and location of the goods;
- logistics method;
- applicable tax and customs rules.
9.3 Where checkout or our Shipping Policy expressly states that applicable import charges or duties are included or prepaid by SKLEYS, we will arrange the shipment consistently with that representation.
9.4 We will not intentionally require a customer to pay an import charge on delivery that was expressly represented during the purchase process as already included or prepaid.
9.5 Where taxes, duties or customs charges are legally payable directly by the customer, this will be communicated where required before the order is placed.
9.6 Nothing in these Terms determines or alters the legal identity of the importer, customs declarant or person liable for a particular tax where that status is determined by mandatory tax or customs legislation and the actual logistics arrangement used for the shipment.
10. DELIVERY INFORMATION PROVIDED BY THE CUSTOMER
10.1 You are responsible for providing complete and accurate delivery information when placing an order.
10.2 If you discover an error in your delivery address, contact:
as soon as possible.
10.3 We will make reasonable efforts to update the address where operationally possible.
Once an order has entered fulfilment or been dispatched, changing the delivery address may no longer be possible.
10.4 If delivery fails because the customer supplied an incorrect or incomplete address, failed to collect the parcel, was unavailable after reasonable delivery attempts, or refused delivery without exercising an applicable statutory right, we may ask the customer to bear reasonable additional costs caused by a new delivery attempt where permitted by law.
This does not remove any mandatory consumer rights and does not apply where the failed delivery is attributable to SKLEYS or its contracted delivery service.
11. LEGAL GUARANTEE OF CONFORMITY
11.1 Consumers are entitled to receive goods that conform to the sales contract.
11.2 Where Spanish consumer law applies, new goods are subject to the statutory conformity regime, including the applicable three-year period of liability for lack of conformity from delivery.
11.3 Where a product lacks conformity, the consumer may be entitled, depending on the circumstances and applicable law, to remedies including:
- repair;
- replacement;
- proportionate price reduction;
- termination of the contract.
11.4 Remedies for lack of conformity will be provided free of charge where required by applicable law, including the necessary costs associated with bringing the goods into conformity.
11.5 A product that is defective, incorrect or materially different from what was agreed is not treated as an ordinary change-of-mind return.
Full information is provided in our Returns, Refunds & Withdrawal Policy.
12. RIGHT OF WITHDRAWAL — EU/EEA CONSUMERS
12.1 Consumers in the EU/EEA generally have the right to withdraw from an online purchase within 14 calendar days without giving a reason, subject to statutory exceptions.
12.2 The withdrawal period generally begins when you, or a third party designated by you other than the carrier, acquire physical possession of the goods.
12.3 To exercise the right, send a clear statement to:
before the applicable withdrawal period expires.
12.4 For an ordinary change-of-mind withdrawal, the consumer bears the direct cost of returning the goods where this has been properly communicated and applicable law permits it.
12.5 Our authorised returns warehouse is located at:
Liu Peiyan Building 2, No. 502-507 Yajing Youth Creative Space Nancun Town, Panyu District 511442 Guangzhou Guangdong China
12.6 Where the product is faulty, incorrect or non-conforming and the return is necessary because of a lack of conformity for which we are responsible, SKLEYS will bear the necessary return costs in accordance with applicable consumer law.
12.7 Complete withdrawal, return and refund rules are contained in our Returns, Refunds & Withdrawal Policy, which forms part of these Terms.
13. REFUNDS
13.1 Refunds arising from withdrawal, cancellation, non-conforming goods or other statutory rights will be processed in accordance with applicable law and our Returns, Refunds & Withdrawal Policy.
13.2 Unless expressly agreed otherwise, refunds are made to the original payment method.
13.3 Processing by your bank, card issuer or payment provider after SKLEYS issues a refund may require additional time outside our direct control.
14. INTELLECTUAL PROPERTY
14.1 The SKLEYS name, website design, text, photographs, graphics, databases and other content are protected by intellectual-property and related laws to the extent recognised by applicable law.
14.2 Content may be owned by SKLEYS or used under an appropriate licence or other lawful basis.
14.3 Some visual assets may be created or modified using artificial-intelligence or other digital tools.
Any rights claimed by us in AI-assisted material are limited to the extent recognised by applicable intellectual-property law.
14.4 Nothing in these Terms transfers ownership of our intellectual-property rights to users.
14.5 You may use the website for normal personal shopping purposes.
Unauthorised commercial reproduction, systematic copying, scraping, republication or exploitation of protected website content is prohibited to the extent permitted by law.
15. ACCEPTABLE USE AND ACCOUNT SECURITY
15.1 You must not use the website:
- for unlawful purposes;
- to introduce malware or malicious code;
- to interfere with website security;
- to attempt unauthorised access;
- to fraudulently obtain goods or services;
- to systematically extract protected information in violation of applicable law.
15.2 If you create a customer account, you should keep your credentials confidential and notify us if you reasonably believe your account has been compromised.
15.3 You are not responsible for unauthorised activity that is not attributable to your acts or negligence where applicable law provides otherwise.
16. PRODUCT SAFETY
16.1 SKLEYS is committed to providing the product and product-safety information required by applicable legislation, including Regulation (EU) 2023/988 where applicable.
16.2 Required information concerning the manufacturer and, where applicable, the responsible economic operator established in the European Union must be provided in the relevant online product offer where required by law.
16.3 Product identification and any warnings or safety information required for the relevant product must also be made available as required by applicable legislation.
16.4 Nothing in these Terms replaces product-specific safety information that must appear on the relevant product page, product, packaging or accompanying documentation.
17. DATA PROTECTION AND COOKIES
Personal data is processed in accordance with our Privacy Policy.
Our use of cookies and similar technologies is described in our Cookie Policy and is subject to the cookie consent choices made available on the website where applicable.
18. THIRD-PARTY SERVICES AND LINKS
Our website may contain links to third-party websites, payment providers, social networks or other external services.
Those third parties are responsible for their own services, terms and privacy practices.
Nothing in this clause excludes responsibility that SKLEYS is legally required to assume.
19. LIABILITY
19.1 Nothing in these Terms excludes or restricts:
- mandatory consumer rights;
- liability that cannot legally be excluded;
- liability for fraud;
- liability for death or personal injury where it cannot legally be limited;
- mandatory rights relating to defective or non-conforming products.
19.2 To the extent permitted by applicable law, SKLEYS is not responsible for losses caused exclusively by events that could not reasonably have been foreseen or avoided despite reasonable measures.
19.3 For consumers, no provision of these Terms limits liability in a way prohibited by mandatory consumer law.
19.4 For business customers, and only to the extent permitted by law, liability for indirect or consequential commercial losses may be excluded or limited.
20. GOVERNING LAW AND JURISDICTION
20.1 These Terms are governed by Spanish law.
20.2 If you are a consumer resident in another country, this choice of law does not deprive you of mandatory consumer protections that would otherwise apply to you.
20.3 Consumer disputes are subject to the mandatory jurisdiction rules applicable to consumer contracts.
20.4 Where legally permitted for transactions with business customers, disputes may be submitted to the competent courts of Cádiz, Spain.
21. CONSUMER DISPUTE RESOLUTION
Where applicable, consumers may have access to recognised consumer dispute-resolution mechanisms, including the Spanish Consumer Arbitration System.
The former European Union Online Dispute Resolution (ODR) platform has been discontinued and is therefore not presented as an available dispute-resolution channel.
22. CHANGES TO THESE TERMS
22.1 We may update these Terms to reflect changes in:
- applicable law;
- our services;
- our operational processes;
- payment or delivery systems;
- other legitimate business requirements.
22.2 The Terms applicable to an order are the Terms in force when the relevant purchase contract is concluded.
22.3 Changes will not be applied retroactively to remove rights acquired under completed purchases.
23. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, that provision will be interpreted or removed to the minimum extent necessary and the remaining provisions will continue to apply.
